Congress Gearing Up for Conference Committee on Regulatory Reform
Congress will begin conference committee negotiations this week on H.R. 4173, the Wall Street Reform and Consumer Protection Act. Negotiations are expected to continue throughout the month of June.
Congressional leadership expects the House to vote on a reconciled regulatory reform bill for the president’s signature by June 29, leaving the Senate with three days to vote on the bill before recessing for the July 4 holiday.
The Senate has named its conference committee members. The House expects to name its conferees on Tuesday, June 8 and will be appointed by Rep. Barney Frank (D-MA), Chairman of the House Financial Services Committee.
The conference committee will use the Senate version of regulatory reform legislation as its foundation for negotiations. This works to NAILBA’s advantage because the Senate bill is the version that does not include language imposing a uniform standard of care. Instead, the Senate version includes language that commissions an SEC study of the role of brokers, dealers and investment advisors in the provision of financial advice.
However, the Obama administration has come out in support of a uniform fiduciary standard. NAILBA has been working diligently with agent groups NAIFA and AALU to ensure the study language was included in the Senate bill and will continue working to see that the standard of care study remains in the final version of H.R.4173 for the President’s signature.
